1. Acceptance of Terms
By accessing and using OptimizeYourImage (the "Service"), you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must not use the Service.
2. Service Description
OptimizeYourImage provides free, unlimited-count browser tools and a separately metered paid developer API. The browser tools include image optimization, HEIC/HEIF conversion, background removal, and text-behind-object effects. The developer API provides synchronous image optimization using prepaid or subscription credits. Browser tools process selected images locally. Images deliberately submitted to the API are processed on our servers without persistent source or output storage. We may change, suspend, or discontinue a feature, supported format, limit, or plan, subject to any rights that apply to an existing paid order.
3. Client-Side Processing
Images selected in the free browser tools are processed locally using technologies such as Canvas API, Web Workers, WebAssembly, and WebGPU and are not intentionally uploaded. This section does not apply to the developer API: by sending an API request, you instruct us to process that request on our servers. API source and output files are not retained after processing completes.
4. User Conduct
You agree to use the Service only for lawful purposes. You may not: • Process content that is illegal, harmful, or violates third-party rights. • Interfere with, probe, overload, or bypass the Service or its security and credit controls. • Share, resell, or expose an API key except as part of an expressly authorized integration. • Automate the browser tools in a way that disrupts other visitors. Automation through the documented developer API is permitted within the applicable credit, concurrency, and rate limits.
5. Intellectual Property
You retain all rights to images you process and grant us only the temporary rights necessary to process an API request you submit. We do not claim ownership of your content. The Service itself, including its design, code, documentation, and branding, is protected by intellectual property laws and remains the property of OptimizeYourImage and its licensors.
6. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we handle data. By using the Service, you consent to the practices described in our Privacy Policy.
7. Billing, Credits, and Cancellation
Paid API access is sold through subscriptions and one-time credit packs. One successful image consumes one credit. Failed validation or processing does not consume a credit. Subscription credits expire at renewal and do not roll over; top-up credits expire 12 months after purchase. Requests stop when no usable credits remain, and we do not charge automatic overages. Polar acts as the merchant of record for checkout, invoices, applicable tax, refunds, and payment processing. Current prices and plan limits are displayed before purchase. Subscription changes, cancellation, and invoices are managed through the hosted customer portal. Mandatory consumer rights and the billing provider's applicable terms continue to apply.
8. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or that compression results will meet your specific requirements.
9. Limitation of Liability
To the maximum extent permitted by applicable law, OptimizeYourImage and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, profits, or goodwill, arising from your use of or inability to use the Service.
10. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to this page. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
